Proposed constitutional amendment to outlaw same-sex marriage will play role in election
The judges and the courts (who are writing law these days) know best apparently…
Another constitutional scholar, University of Southern California law professor Erwin Chemerinsky said it is likely that laws that prohibit same-sex marriage cannot, in the long term, survive the reasoning of the (Supreme Court) majority in Lawrence.
So, the reasoning abilities of the general public do not compare to those of the Supreme Court? Are we intellectually inferior or culturally naive…and we have rely on judges to determine what’s best for us?
One thing seems certain: If same-sex marriage is to be made legal across the nation, it will happen by court rulings and not by legislation. Thirty-eight states have laws or state constitutional provisions that ban marriage between same-sex couples.

The country is polarized because we have a president who is polarizing. I mean, look at what he did the other day with a constitutional amendment, Kerry said in February when Bush endorsed a constitutional amendment to define marriage. He’s trying to divide America. You know, this is a president who always tries to create a cultural war and seek the lowest common denominator of American politics.
It’s not Bush or the public bringing the same-sex marriage issue to the table. If Senators are frustrated that they have to deal with this right now, they should thank the Massuchusetts supreme court for opening up the flood gates on this one.
